A U.S. District Court judge has terminated a suit filed against the City of Evanston two years ago alleging that members of the police department violated a citizen’s 14th Amendment rights. malicious prosecution, and indemnification involving an arrest for murder in 2010.

Judge Jorge L. Alonso of the U.S. District Court for the Northern District of Illinois, granted a motion presented by the city for a summary judgment, which terminated the suit.

In December 2012, the plaintiff , John A. Bamberg, Jr., was found not guilty after a trial at the Skokie Court House.

In his written opinion, Judge Alonso found ‘no genuine issue of material fact’ in the claims against the City of Evanston.
